GENERAL TERMS AND CONDITIONS OF DISTANCE SELLING OF LELIEVRE PRODUCTS


Preamble

LELIEVRE is renowned for its traditional business as a manufacturer and distributor of collections of furnishing fabrics and home accessories. Its top-of-the-range products are distributed exclusively to professional clients around the world.

In wishing to establish a greater presence with the end consumer, LELIEVRE has decided to offer a distance selling service
* limited to its decor accessories, cushions, plaids, curtains and similar products, as shown on its website, bearing the LELIEVRE, KENZO-MAISON and ALCANTARA-HOME labels,
* accessible only via its website at www.lelievre.eu,

It is emphasised that LELIEVRE does not engage in any telemarketing to private individual prospective customers. Therefore, articles L.121-21 to L.121-27 of the Consumer Code, which relate to doorstep selling, do not apply to these general terms and conditions of sale.
However, purchasing via the Internet, resulting from an active approach by the customer, is subject to the conditions of distance selling governed by articles L.111-1, L.113-3 and L.121-18 of this Code.

You will be asked to declare that you have read and accepted these general terms and conditions of sale before placing your order.
In validating your order, you are deemed to have accepted these general terms and conditions of sale.
Data registered on lelievre.eu constitute proof of all transactions carried out between you and us

Article 2: Orders

All the stages required for selecting and purchasing are indicated on the site.
You will have to identify yourself at the time of your first order by filling in a number of mandatory fields, so that you can be contacted, if necessary.

All products displayed on the site are, in theory, available in stock in sufficient numbers. If, on preparing the delivery, a problem with quantity should arise, you would be informed immediately.
Photographs and descriptions of products on offer are for information only and do not commit LELIEVRE. Further information is available by phoning the Company’s customer services department:
no. 01 43 16 88 00 (e-commerce Department).

LELIEVRE checks all orders that have been validated on its website. Therefore, you may be asked for various documents required to release your order: proof of identity and address. These requests are sent via e-mail.

Article 3: Prices

The prices of the items are indicated in euros, inclusive of all taxes, with delivery costs extra.
Before final validation of your order, you will be able to check the retail price per item and the transport charges.
This display will appear identically on the invoice which you will receive separately by mail.

Article 4: Terms of payment

Payment with the order is mandatory. There is no entitlement to a discount for payment in cash.

Settlement must be made by banker’s card: only Visa and Eurocard/Mastercard issued on French bank accounts are accepted.

An order can only be validated once your payment has been recorded.
However, the card shall only be debited at the time of processing the order.

By way of exception, you may ask to pay by bank transfer, by making a written request in this respect in the space indicated in ecommerce@lelievre.eu, in the “contact” heading.
Where applicable, LELIEVRE might require you to pay by transfer.

In the context of payments via the Internet, and in order to combat Internet fraud, a check will be carried out online with the competent banking institutions via a specialised company.
Our website is highly secure: your credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never sent over the network in clear text.

Article 5: Delivery

When you enter your order, a delivery lead-time is displayed, normally 3 to 4 working days.

However, at the time of preparing your order, it may be that we notice a total or partial stock shortage; in this case, we shall contact you to offer a rescheduling of your order. You can then accept this offer or, on the other hand, reject it and cancel all or part of your order. In this latter case, the debit to your card will be corrected for the amount of the cancelled items.

In any case, article L.121-20-3 provides for automatic cancellation of an order in case of a delay of more than 30 days.

In accordance with article L.121-1 of the Consumer Code governing distance selling, the customer has the option to return the goods within 7 days, in their original packaging, complete, accompanied by the return slip duly filled in, and a copy of the invoice, to the address of the Company’s registered office.
Items returned incomplete, faulty or damaged shall not be refunded.

Article 6: Information and complaints

For any information or complaint, you should contact the LELIEVRE customer relations department on telephone no. 01 43 16 88 00 (e-commerce Department) or by e-mail to ecommerce@lelievre.eu, stating, where applicable, your order number.

Article 7: Electronic files – protection of privacy

The information and data concerning you are required to manage your order and for our business dealings. This information and data are also stored for the purposes of security, in order to comply with legal and regulatory obligations, as well as to enable us to improve and personalise the services that we offer you.

In accordance with the data protection act of the 6th January 1978, you have a right to access and correct personal data concerning you. You simply have to write to us online at ecommerce@lelievre.eu, indicating your surname, first name, e-mail address and, if possible, an order number.

Article 8: Intellectual property

LELIEVRE, KENZO, KENZO-MAISON and ALCANTARA-HOME are registered trademarks. All illustrations and images, texts and comments appearing on the lelievre.eu website are reserved under copyright as well as intellectual property. Any total or partial reproduction of the LELIEVRE website is strictly forbidden.

Article 9: Law applicable

This contract is subject to French law.
The language of this contract is French.
In case of dispute, the French courts alone shall be competent.
